Abstract:
This research is a phenomenological examination into the history of the Florida No-Fault law, and enactment of the Personal Injury Protection (PIP) evolution, from its humble beginnings in 1971, through the present. PIP is a compulsory auto insurance coverage for all motorists in Florida. Specifically analyzed, is the PIP social impact, changes, and the major controversies arising out of this law at the legislative, judicial and political grounds. PIP is the most litigated area of the Florida law after property foreclosure cases. In fact, PIP cases formed the majority of civil cases filed in the Florida courts prior to the “financial meltdown.” The performance of the Florida No Fault in the past 40 years is highly debated in the legal forums, but the average auto insurance policy holder in Florida knows little or nothing about the PIP controversy and its financial and social impact.
